This privacy policy ("Privacy Policy") applies to the http://www.yespix.com website and other websites owned or operated by YesPix, LLC., which we may refer to as we, us or the Company, and to those services ("Services") we provide to you, and discloses to you how we may use the information and materials that you or others on your behalf submit to the Company through these websites, and how you can access, add to, remove, change or correct this Content, and how you can place certain restrictions with respect to the availability of specific Content for use by third parties.

SUBMISSION OF CONTENT TO THE COMPANY

You will, at your discretion, submit to us, by the means and in the manner determined by us (including but not limited to by use of one or more websites), information and opinions, and photographs and images relating to individuals, groups, events, locations, products, topics of interest, goods and services, and such other information and opinions you choose or as suggested by Company (collectively, "Content"), for use by you, and by us and certain third parties.

The Company will characterize, categorize, and organize the Content in a database for purposes of creating searchable indices to facilitate auditioning and use by you, and by the Company and third parties. You may instruct the Company to characterize, categorize and organize your Content in a manner which is compatible with that employed by the Company.

You may only submit to us Content that you own or have all necessary rights, licenses, consents and permissions to authorize the Company and third parties to whom you or the Company makes the Content available to reproduce and use in various media, including by means of public distribution, posting, exhibition, broadcasting, transmission, display or publication. You shall not submit any Content the submission of which, or the use of which, will violate or infringe upon any common law or statutory rights of any third party or person, including, without limitation, ownership rights, contractual rights, copyrights and rights of privacy. By using the Service you consent to having the Content transferred to and processed in the United States.

You accept and agree that the nature of the Content submitted by you shall be your responsibility, and the Company shall have no obligation to screen, filter or edit any such materials. You agree to indemnify and hold harmless the Company for any claims or damages arising out of Content submitted by you which is alleged to result in defamation, slander or libel. You further recognize that any Content submitted by you may be made publicly available as a result of submission by you or a person on your behalf, and you agree to indemnify and hold harmless the Company for any claims or damages arising out of such submitted Content becoming public.

AVAILABLITY AND USE OF CONTENT

You may search and access the Content stored by the Company by the means and in the manner determined by the Company. You may provide certain Content to third parties through use of the Service through your own actions without any instructions to Company. The Company shall maintain a secure system pursuant to which third parties may access only that Content that you have chosen to make available to them. You may grant the Company permission to provide Content to third parties in its discretion, subject to any restrictions that you have placed on specific Content, such as restrictions on territory, or the media or means by which Content is used. You may place restrictions on certain Content by either tagging the specific Content at the time of submission, or by subsequently instructing the Company to apply the restrictions. The Company will only make Content available to a third party pursuant to specific instruction, authorization or permission granted by you.

WITHDRAWAL OF CONTENT

You may instruct the Company to withdraw specific Content from its websites and remove such Content from the Service, and change or edit submitted Content. The Company may withdraw Content which it reasonably believes may result in claims of infringement of rights of publicity or rights of privacy.

PUBLICLY AVAILABLE CONTENT

The Company shall only make available Content as instructed or permitted by you. Notwithstanding the foregoing, you accept and agree that with respect to Content that is either at the time of submission or later becomes publicly available, the Company shall not be deemed to be in breach of its obligations hereunder to maintain such Content private and subject to your control, nor shall the Company be held responsible or liable for, any claim arising out of the use of such publicly available Content which use is not made possible as a result of utilization of the Service.

SECURITY OF CONTENT

While we will take all reasonable measures to insure that your Content is not accessible to any unauthorized persons, we cannot guarantee that only authorized persons will access your Content. We are not responsible for third party circumvention of any security measures employed by the Company. You acknowledge that any and all information and data exchanged between you and the Company through any Internet website may be viewed or tampered with in transit by a third party. The Company will use its best efforts to maintain effective measures to protect all submitted Content; provided, however, that you agree to hold the Company harmless for any claims or damages arising out the breach of the Company's security measures.

NEWSLETTERS AND ANNOUNCEMENTS

We may use your username and email address to provide you with email newsletters and announcements. If you do not wish to receive these kinds of communications, you can opt out by unchecking the email newsletters and announcements boxes during registration. We also offer you the option to unsubscribe from newsletters and announcements by return email or by changing your profile on the site.

NO RESPONSIBILITY FOR THIRD PARTIES

By using the Service, you acknowledge that you will cause or permit Content to be shared with third parties. To the extent that Content is made available to third parties, including third party websites or networks that are not owned or controlled by Company, you acknowledge that the Company has no control over the practices of such third parties, and you agree that Company assumes no responsibility for, the configuration and content, privacy policies, or practices of any third party website or network. INFORMATION RETAINED BY THE COMPANY

We may retain the details of transactions that you make through the Service, including interactions with other websites and persons, including business entities and individuals. We may require that third parties who receive Content from you report to us the nature of the use made of the Content, and the extent and related market of use, and the specific revenue generated by any advertising or other means of exploitation associated with the Content. YOUR CALIFORNIA RIGHTS

Residents of the State of California, under the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the Company has disclosed personal information during the preceding year for direct marketing purposes and a disclosure of the shared information. This Company qualifies for the alternative option. Therefore, we are not required to maintain or disclose a list of the third parties that received your personal information during the preceding year for marketing purposes.
